"Let the Time Fit the Crime"
Community Members Rally Outside of Santa Clara County Courthouse

San Jose, CA -- On Monday December 4, 2006 the organization Families Against Injustice to Humanity (F.A.I.T.H) and many concerned community members rallied outside of the Santa Clara County courthouse to give their support to some young men currently in trial and to raise the awareness to the District Attorney's misuse of gang enhancement laws. Around two dozen people held signs that read, ÒPrison is Not the Answer,Ó and ÒEducation not Incarceration.Ó Passerby's took flyers from the group as they walked into the courthouse.
Lynn Agbalog, F.A.I.T.H member, says, ÒLet the time fit the crime.Ó She says the problem with the gang enhancement law is that it's being abused by the D.A. and becoming a tool to throw our young people away. The gang enhancement law was implemented to keep hardened gang members that are involved in violent crimes off the street, by adding years to their sentences. The problem is that there are young men that are involved in non-violent crimes and even first time offenders that are facing life sentences as a result of this law.
The rally was energetic, yet peaceful with a mixed crowd that was made up of grandmothers, parents, and friends that all have loved ones that have fallen victim to the abuse of the gang enhancement law.
The sense of the crowd is that their community is under attack and targeted by the San Jose police department and the County prosecutors. They expressed this with signs that read, ÒWhere we live doesn't make us a gang memberÓ
The majority of the crowd is from the Meadow Fair area located in east San Jose, where they have thirteen young men with ages ranging from 18-23 who are have either recently been tried, or are about to be tried for various crimes, and are all facing gang enhancement sentences. Freddy, a middle-aged Meadow Fair community member who was protesting today, says he has seen police harassment intensifying in his neighborhood.

Thank you for the support line. We have an overzealous DA in Riverside County who is putting gang enhancement on everything. He is nuts. We currently have 7 white males ranging in age from 18-21 in
jail for what one nut case did. because they were all drinking a beer together they are a "gang" and the gang enhancement law. This is heart breaking and gut wrenching.

Thank you for posting this. It is SO VERY important to not only protest, but also to inform the public about the injustices that are going on inside the courtrooms. There is NO justice. We need unite
together and put an end to this horrendous and tortuous sentences that are being dealt out. We the people MUST demand an end to gang enhancement sentences. The prisons are total torture chambers and they aren't fit even for "hardened gang members".
